LMIA-Based Work Permit Applications involve obtaining a Labor Market Impact Assessment (LMIA) to demonstrate the need for a foreign worker. These applications can be processed both inside and outside Canada. These permits are typically for a specified job and duration.

Open work permit(s)

In Canada, open work permits allow foreign nationals to work for any Canadian employer without the need for a specific job offer or employer sponsorship. There are several types of open work permits available, each with its own eligibility criteria and conditions. Here are some common types of open work permits in Canada:

  • Spousal Open Work Permit:This permit is issued to the spouses or common-law partners of temporary foreign workers in skilled occupations. It allows them to work for any Canadian employer.
  • Post-Graduation Work Permit (PGWP): This permit is for international students who have graduated from eligible Canadian institutions. The PGWP allows them to work in Canada after completing their studies. The duration of the PGWP depends on the length of the program completed.
  • Bridging Open Work Permit: This permit is designed for temporary residents who are in the process of applying for permanent residence through Express Entry or certain provincial nominee programs. It allows them to maintain legal status and continue working while their permanent residence application is being processed.
  • Temporary Resident Permit (TRP) Holder Work Permit: Individuals who have been issued a TRP due to their inadmissibility to Canada can apply for this work permit, which allows them to work while their TRP is valid.
  • Humanitarian and Compassionate (H&C) Open Work Permit: In exceptional cases, individuals with pending H&C applications may be eligible for an open work permit on humanitarian and compassionate grounds.
  • Open Work Permits for Vulnerable Workers: In some cases, temporary foreign workers who are vulnerable due to abusive employers or other circumstances may be eligible for an open work permit to protect their rights and safety.
  • Intra-Company Transfer :In Canada, the Intra-Company Transfer (ICT) program is designed to facilitate the temporary relocation of employees from a foreign branch, subsidiary, or affiliate of a multinational corporation to a Canadian office or location within the same corporation. This program is intended to support international business operations and allows qualified foreign workers to work in Canada for a specified period.
  • Holiday Visa Work Permit: In Canada, the Working Holiday Visa program allows young people from certain countries to temporarily live and work in Canada while experiencing the country's culture and lifestyle. This program is part of International Experience Canada (IEC) and is designed for individuals who are citizens of countries that have a bilateral youth mobility agreement with Canada.
